Terms of Service - SKIPJAK
We suggest our users read the below terms and conditions for using the SKIPJAK website or any online site to which our website is connected to, including our social media channels.

Using our website and security
By accessing and using our website at www.skipjak.ie including the customer account, you are agreeing to be bound by the current terms and conditions of use including any relevant local laws. You are entirely responsible for any activity that occurs under your account login which is given to you by SKIPJAK. You agree that you will notify us immediately of any unauthorised use and/or any other breach of security during the use of our website.
Privacy policy and data protection
SKIPJAK gathers and uses your information in accordance with the Data Protection Acts 2018, the General Data Protection Regulation (the “GDPR”) and any Irish implementing legislation (“applicable data protection legislation”). Please review our Privacy Statement for more information on how we use your information and your data protection rights.
We use HTTPS, Shopify encrypted payments and step authentication along with implementing our cookie policy as appropriate security measures.
User conduct of website
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through our website. All information, designs, drawings and other specifications on the website are the exclusive property of SKIPJAK only. Any copying, transmission or re-transmission of the same requires the prior written approval of SKIPJAK failing which the former is prohibited.
Entering into a contract with SKIPJAK
A contract between you and SKIPJAK will only exist for a sale of our product or service once you pay for and submit your order and until we receive notification of the same. We will notify you by email when we have dispatched your order. Acceptance of the order will be deemed both complete and to have been effectively communicated to you at the time SKIPJAK sends the dispatch notification email to you (whether or not you receive that email).
User license
Permission is granted by us to you, to temporarily download one copy of the materials on SKIPJAK website for personal, non-commercial transitory viewing only should you wish to do so. This is the grant of a license on one piece of website material only, not a transfer of title. Under this license you may not:
- Modify or copy the materials;
- Use the materials for any commercial purpose or for any public display;
- Attempt to reverse engineer any software contained on SKIPJAK website;
- Remove any copyright or other proprietary notations from the materials; or
- Transfer the materials to another person or "mirror" the materials on any other server.
In the event that the user license clause has been violated, SKIPJAK reserves the right to immediately terminate your user license. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or an electronic format.
Product prices
All prices for SKIPJAK products will be as stipulated at the time of you placing an order on our website. We are entitled to amend the price to account for an increase in our supplier’s prices, or the imposition of new taxes or duties, or if due to an error or omission, the price for one of our products is incorrect.
Product specifications
We sell kayaks, wetsuits, water socks, paddle boards, life jackets and water shoes. Many of the products are of a bespoke nature and may vary in colour/style. Therefore, whilst we will include as much details as possible for our product descriptions, it is not reasonably practical to keep specifications completely up to date. All descriptive matters, drawings, pictures, colours, specifications and advertising on the website are for the sole purpose of giving an approximate description of the products to the best of our ability and knowledge.
We are provided with delivery timescale estimates from the shipping lines and these are written at the top of the product descriptions for all customers before they purchase the kayaks with us. There may be unforeseen delays outside of our control. For more information, see below under ‘pre-order of kayaks’.

SKIPJAK website is powered by and uses Shopify Payments to provide a secure, robust, encrypted and reliable payment processing service.

We ship our accessories with DPD.
Pre-order of kayaks
For kayaks, the time period for dispatching varies and will normally involve placing a pre-order with us. Due to the nature of kayak products, it can be approximately 2 - 3 months before stock arrives to us. How long you wait on a pre order will depend on how close to the estimated arrival date you place the order by.
NB When you place a pre-order on a kayak, we will display an estimated delivery date. Please note, with this being an estimated delivery date, we are relying on the current shipping lines we are given. There will be occasions where we may go past our estimated delivery date and naturally this will impact the estimated arrival times. Consequently, we are not held liable for any delays on shipping lines, as this is outside of our reasonable control. You are therefore agreeing to this clause in the event you process your kayak order with us.
All other products
We aim to dispatch all other products including accessories within 3 working days of placing your order if you are within and/or we are delivering within the island of Ireland.
Delays
We must advise on the ad hoc occasion, there may be a delay with the product availability, which may be outside of our control. Any dates specified for delivery are based on what we aim to achieve to dispatch and deliver your order.
In the unlikely event the delivery of your order (excluding kayak orders) has to be or has been delayed for more than 1 month outside of our usual timescales above, you can of course contact us via email info@skipjak.ie and can cancel your order. In these unfortunate circumstances, we will of course refund any money paid by you for our products including the cost of delivery. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer in the event we have had to delay the dispatching, delivering and/or supplying of our products. On the date of delivery, you will need to sign-off the delivery of the product on receipt, after which time the product becomes your sole responsibility.
Advertising and promotions
SKIPJAK reserves the right at all times to place advertisements and promotions on the website. Advertisers and sponsors on our website must comply with all local, national, state and international laws (where relevant) and are solely liable for their actions.
Health & safety of handling/using our products
Our products are CE and ISO certified from our suppliers in order to sell life jackets, buoyancy aids and kayaks.
If any manuals or safety instructions are provided with the products, you agree to read and follow the instructions and clauses contained within the same. Any information contained on the website is not intended to be comprehensive and if you are inexperienced in using our outdoor sports products or are unsure of your abilities in using them, you should seek professional advice and assistance before use.
Our products themselves are safe and will not cause harm unless they are misused and if the kayaks are not driven safely and competently. We must advise that if the kayaks are not used properly and correctly then there is a potential risk of injury or death. As with any vehicle, please only use kayaks if you are able to use the kayaks correctly!
Disclaimer
All the materials on SKIPJAK ’s website are provided "as is". SKIPJAK makes no warranties, may it be expressed or implied, therefore negates all other warranties. The information on our website is for information purposes only and, although we have made every effort to ensure the correctness of the information, the said information is provided as stated/specified/displayed and without warranties or conditions of any kind whether express or implied. Furthermore, skipjak does not make any representations concerning the accuracy or reliability of the use of the materials on its website or otherwise relating to such materials or any sites linked to our website.
We do not warrant or represent that the use or the results of the use of the materials available through the website or from third parties will be correct, accurate, timely, reliable or otherwise. We accept no liability for any of the above but this does not affect your statutory rights.
Limitation of liability
To the fullest extent allowed by the law, under no circumstances, including, but not limited to, negligence, are we liable to you or any recipient, for any direct, indirect, incidental, special or consequential damages that result from the use of and/or the inability to use the materials on our website, any changes to the website, data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the products. This does not impact your legal right of recourse under the relevant data protection legislation. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages and therefore these limitations may not apply to you depending on your jurisdiction.
Proprietary rights
All of the content which includes but is not limited to text, software, music, sound, photographs, video, graphics or other material on our website, within our advertisements or subscription emails, commercially information by our website, by us, or our advertisers or other content providers, is protected by trademarks, copyrights, patents/service marks and/or other proprietary rights and laws that are applicable.
Performance of our contractual obligations and legal jurisdiction
We shall not be liable for any failure to perform our obligations under these terms and conditions as a result of circumstances that are beyond our reasonable control. This includes but is not limited to a force majeure incident. Any such failure to exercise or enforce a right or provision of the terms of use will not constitute a waiver of such right or provision unless we have both acknowledged and agreed to this in writing.
The terms of use are governed by and construed fully in accordance with the laws of Ireland. We both agree to submit to the exclusive jurisdiction of the courts located in Ireland. If any provision of the terms of use is held by a court of jurisdiction to be contrary to law, then such provision will be construed to reflect the intentions of the parties with the other provisions that are in full force and effect.
Amending the terms and conditions including our policies
We reserve the right to change the terms of use or any of our policies regarding the use of the website, our products and/or services (including product descriptions, prices or and/or product availability) at any time and may notify you by the act of posting an updated version of our terms of use on the website. The materials on SKIPJAK website may include technical, typographical, or photographic errors and we cannot promise all the materials are completely accurate. SKIPJAK may need to change the materials at any time without giving prior notice.
Changing or terminating our website
We may amend or terminate the website with or without an explanation at any time and effective immediately. In addition, we reserve the right to terminate your customer account in the event there has been any violation of these terms of service, regardless of the reason that has resulted in such violation. If you have made an accidental oversight during the use of your customer account which may potentially, or, has violated the terms of service, please contact us immediately by email on info@skipjak.ie
Reference to other sites on our website
SKIPJAK is not responsible for content including its accuracy of websites that are linked to our own website page. The presence of any link does not imply endorsement by SKIPJAK of their sites. The use of any linked website is at the user’s own risk.
Relevant tax and duties
VAT is included in all our product prices.
Non-EU countries may be subject to tax and duties on goods that have been purchased. Payments of tax and duties are the responsibility of the receiver of the goods (products). SKIPJAK is under no circumstances liable for country specific custom taxes, duties as a result of delivering your package. Please contact your local customs office for more information on potential liabilities that will apply to the recipient.
Customs clearance outside of Ireland
We must highlight that every country has its own customs clearance levels. Although most countries accept all imports, some items may be refused entry to a specific country. You should check with your local customs office who can advise on the items that cannot enter the country or that may cause problems at customs.
The recipient may be liable for additional charges that may be incurred and it is the customer’s full responsibility to familiarise themselves with the laws and rules on customs that apply to the country where the order will be sent and preferably, before placing their order.
Returns policy
Cooling-off period to cancel an order
When you purchase online, you have a statutory right to return a product up to 7 days after your order has been delivered (this is known as the ‘cooling-off period)’, this is extended to 14 days if you are in the European Union. You can change or cancel your order up until it is dispatched by our team. If the order has been dispatched, you can return the product to us and we will arrange a refund but this may include return shipping charges.
Returns policy
The return policy outlined below applies to all online orders.
We have a 30-day returns policy, which means you can request a return on full priced products within 30 days of receiving your order if you change your mind. You must contact us within this time period and the item/s must be unused, unworn and in the exact same packaging as well as a saleable condition. You must also retain your receipt or proof of purchase. We will inspect the items being returned to us to ensure all is in order.
Shipping charges on returns - For damaged or faulty products we do not charge a shipping fee to return the product to us or for collection. However, for all other reasons such as changing your mind on a kayak order, please be aware that we charge a €45 collection fee to collect the kayak.
Damaged items
Once you receive your items please ensure you inspect them. In the event that your item is damaged and/or defective or you have received the wrong item. Please contact us by email at info@skipjak.ie and include your order reference number and full name. We also require a photographic image of the item displaying the damage. Once we have reviewed the matter, we will try to resolve this for you as soon as possible to avoid further delay.
Exchanges
You must contact us within 30 days of receiving your order to request your exchange. You must contact us within this time period and the item/s must be unused, unworn and in the exact same packaging as well as a saleable condition. You must also retain your receipt or proof of purchase. We will inspect the items being returned to us.
Once we receive the original item and the refund is approved, please make a separate order for a new item. We will reach out to you for payment of the re-shipment and any other additional charges that apply (if applicable). If you are due a refund due to the difference in prices of both orders we will process this to your original payment method and then ship the replacement items as soon as we are able.
How to request a refund/exchange
To start a returns request, please contact our team by email at info@skipjak.ie and include your order reference number and full name. If your return is accepted, for a kayak order, we will collect the kayak and send you a new kayak. Or we offer you a full refund if we don’t have stock available to replace it.
For all other products, we will send you a return shipping label, as well as instructions on how and where to send your package. Items that are sent back to us without prior request of a return will not be accepted by us.
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved and you are to be given a refund, you’ll be refunded on your original payment method. Please remember, it can take some time for your bank or credit card company to process your refund depending on their individual timescales.
Exceptions / non-returnable items
Unfortunately, we do not accept any returns on sale items or gift cards. Other than this, there are no other products that are excluded from the policy.
If you're unhappy with our products or services / want to provide feedback
If you are unhappy with the products or services that you have received from us or would like to provide feedback, please let us know so that we can assist. You can email us at info@skipjak.ie. Please include as much information as you can including the order reference, email address and contact number including what an ideal outcome would be. We will look into this matter for you within 14 days and aim to provide a full response within 28 days.
We hope that we will be able to resolve any complaint and outcome to the best of our ability and in line with your expectations. However, if you are unhappy with the outcome, you can also submit your complaint to an Online Dispute Resolution process provided by the European Commission at https://ec.europa.eu/consumers/odr
